olqe 考过后申请律师牌的步骤 steps after passing the OLQE
自从写了两篇（1、2）关于香港olqe考试的文章后，我以为这个事情可以就这样结束了。。。因为接下来要再去取得律师牌，无非是要（以下信息获得于2021年，不能作准或被依赖，仅为个人体验，建议如果有任何疑虑直接联系各机构确认 all information below, which are solely based on personal experience, should not be relied upon. If in doubt, please contact the relevant authorities.）：
1、用考试通过的通知向律师会申请一个什么certificate（3号表格），为此，要填一个叫1C的表格，一个5号表格，同时律师会还需要给他们发一个你会去拿律师牌的通知（notice for… practise certificate之类）
A Form 3 certificate is needed for admission. To obtain the Form 3, you’ll need to file a Form 1C, a Form 5, and a Notice for applying a practising certificate with the Law Society.
这里1C表格的填写有些律师会没说的事情：
(a) 香港身份证的ctc要用跟填写说明上面不一样的语言来certify。。。一般律师有那个章，总之要说明那个文件是 true and complete copy of the original
the certification language for the HKID should be different from the sample provided. a solicitor’s stamp for certified true copies should suffice (which contains the language “true and complete copy…”)
(b) 纽约第一部门不发admission certificate的问题再次浮现。。。这次要多做一个declaration
needs a separate declaration for 1st dept NY qualified attorney. The law society will provide a sample when giving the 1st feedback.
(c) 填通过的考试的时候，要把所有的head全部写出来
needs to specify all heads in the olqe in Form 1c
(d) 要证明你这三个月都在香港，除了填写说明里的护照，还要提供租房合同，水电煤账单，以及雇主证明
might request additional documents to prove that you are in HK during the 3 month period, such as lease, water/power/gas bills, employment reference.
2、拿到那个certificate，向高等法院file 一个motion，请一个律师move你被法院admit（如果是inhouse，motion是per se去file的，但是mover还是要有个律师，是分别的）；这个动作要在收到certificate原件后2个月内去弄；motion paper和certificate的copy要向律师会和律政司提供（motion paper不要找律师certify，法院会盖印；certificate要做两份certified true copy，“ctc”），另外还要向法院和律师会写一封信，告诉他们谁会做你的mover（一定要按照信的格式来，不然会被拒收。。。）。总之：
After receiving Form 3, you need to file a notice of motion with the High Court. If you are in private practice, you can ask the firm to do all these. If not, you will have to file the motion per se (not the same with having a mover). The notice needs to be filed within 2 month after receiving the Form 3. The notice should not be certified, as the court will certified the copies of the notice themselves. A letter (must be in a letter format) should also be handed to the High Court and the Law Society, informing them who will be your mover.
(a) 准备form3的certificate的两份ctc
prepare two certified true copies of your Form 3
(b) motion paper 准备一份原件，两份复印件，不要做ctc；如果inhouse，motion paper的格式要稍微改一下，写成以applicant自己的名义去move（除非你请律所帮你file那个motion）
prepare one original notice of motion, and make two copies. The copies should not be certified. The format of the notice needs some format changes if applying per se (applying as the applicant, not as a solicitor)
(c) 准备一样的信两份，告诉法院和律师会谁会做你的mover
prepare two letters informing the high court and the law society regarding your mover
如果你是inhouse，拿着上面三份文件去high court（如果你是律所律师直接交给你的秘书搞定）。先去金钟的high court building： take all documents to the High Court
(a) 的LG2层缴费，他们会在你的motion上印上已缴费的字样
go to LG2 to pay the fee; they will print on your motion paper that the fees are paid
(b) 再去LG1（LG1在LG2的楼上，依此类推）找个窗口，里面的人会检查格式什么的，然后给你一个案号
go to LG1 (above LG2); they will check if your docs are in order, and assign you a case number
(c) 去G层（在LG1的楼上）的clerk那里（1号窗口A/B）确认宣誓日期，他们会填到你的motion里去（我当时是三四个月后）；把时间信息填入准备的另外两份motion paper的复印件上
go to G level (above LG1) and find the clerk (Window 1 A/B when I was there) and fix the admission date. Could be 3 to 4 months later. Fill in the admission date on the two copies of the motion paper.
(d) 回到LG1刚才那个窗口，正式file你的motion，窗口会在你的两份motion paper复印件上盖法院的印章（他们就不能把这些窗口集中一下或者至少放在同一层吗。。。）
go back to LG1 and file your motions. The clerk will affix court seal on your copies of the motion paper.
(e) 分别拿着你的其他文件交给律政司（在圣公会的圣约翰座堂背后）和律师会，律师会的要多那份信
hand a copy of your motion paper and a copy of your Form 3 to the Department of Justice. hand the same things plus the letter regarding the mover to the Law Society.
自此，就是等待宣誓。。。还要租律师袍什么的。等宣誓完了才能去apply for practice certificate
Rent and borrow robes for yourself and the mover.
另外，律政司的信打电话问了，会在admit之前一个星期的时候寄出来，所以收到的时候也快要去admit了。。。最好留一个fax号码以便接受这种东西
The DOJ will send you a letter of no objection (if they really are not objecting). The letter might arrive within one week before your admission date. Better leave them a fax number for this.
离宣誓还有两周的时候，法院会fax给你（如果有留fax nubmer）或者寄给你一封信，有关宣誓的具体细节。
Approx. 2 weeks before the admission, the high court will fax you (if you left a fax number) or send you by post a letter regarding the details of the admission ceremony.
3、去法院宣誓
宣誓那天，根据法院寄来的信的说法，可以一共带8个人进去（包括mover），mover要讲三分钟的话。如果因为疫情，可能也会改成书面替代讲话，能进去的人也可能减少为5个。拍照必须在指定时间指定场所（但不是在法庭内，也不能在高院正门太近的地方）。
Per the letter from the high court, a total number of 8 people (including the mover) can accompany the applicant to enter the courtroom. For the purpose of preventing the pandemic, the oral speech by the mover might be substituted by a written speech, and the number of people might be decreased to 5. Photos can be taken at specified time and specified location, but not inside the courtroom, nor in close proximity of the front of the high court building on the ground floor.

给师兄update一下我的OLQE之路：因为我之前在香港拿到过PCLL（各种原因毕业后回深圳了），我可以根据Rule 5(2)申请豁免OLQE的所有考试，as long as我在大陆做见习律师+执业律师满三年。我在大陆做见习律师期间转过律所，见习期间断需要从头算，BUT香港law society称大陆的见习律师无论多长他们只承认法定的期限（即1年），这么一来我就见习+执业不满三年了。so今年OLQE之旅走到了尽头……

兄弟你是在律所还是inhouse？我今年考剩下的一门Head IV，大概率明年能通过，可是我很可能4月份换工作，从律所去inhouse，所以就不知道在等待admission的期间换去inhouse是不是会影响admission。兄弟你一定需要雇主出具或办理，绕不开的项目有哪些呢？

如果你申请admission（拿form 3的certificate）的材料交了以后才转换工作应该不影响。如果你还没交，有关雇主需要提供的东西，其实律师会想找你要的是一个能证明你在申请后三个月（或者其他允许的时间段内）还有权留在香港的文件（我理解如果你已经有永居了应该不需要雇主提供什么东西证明，但具体应以律师会的反馈为准），所以只要你任何一个雇主提供的东西能反映这个情况就可以（随便找张公司的信头纸写下这种内容然后找一个愿意帮你签字的公司的人签一下）。
我当时在inhouse的时候所有的一切都是自己搞定的，如果你还在律所，很多东西可以让律所帮你搞（有很多东西需要打印在信头纸上）。如果你律所不知道你要走当然还是可以让你律所帮你了。

一年又一年，今年再次提交申请，还没等到回复……根据去年的经验，会在五一假后有结果。等待的时间真难熬……

果然又有新的问题出现：申请Certificate of Eligibilty for Admission需要提交Form 1C，而Form 1C显示需要在香港的非本所Solicitor/Commissioner for Oaths面前签字，而我现在还没有去香港的working visa（个人游签证还停办了……）。如果现在办Working Visa，则Law Society需要我提供form 1C才会给一个non-objection letter……陷入死循环了

你那边使劲找的话也许可以找到一个香港律师吧。。。实在不行的话内地公证处可以吗，你问下law soc 试试
我记得好像一共有三个表，有一个表还得再找一个香港律师。。。你可以看下我上面文章也许提到了
当然最终你还是需要一个工签的，因为有要待三个月的规定，除非你已经pr了

我没申exemption，除了common law自动exempt的head 6。当时听说一般只能exempt掉2和3，即便有很多年经验
